Discover Languages and Discover Languages – Discover the World, along with the Discover Languages logo, are registered service marks of the American Council on the Teaching of Foreign Languages (ACTFL). ACTFL has invested considerable resources in the development of the Discover Languages concept, name and logo design. We therefore must prevent any unauthorized use of the service marks by any individual or organization. The Year of Languages campaign during 2005 was designed to create excitement around and draw attention to the importance of language learning. Discover Languages will continue this effort on a permanent basis, building on the success of the Year of Languages. Because this is the theme of a sustained public awareness initiative, the guidelines for use of the theme and logo are different from those governing use of the year-long 2005: the Year of Languages campaign. All use of the Discover Languages name and logo must clearly indicate that it is an ACTFL initiative and must adhere to the following restrictions. I. Non-profit use
The logo may be used for non-profit purposes. Language education associations and other non-profit language-related organizations may use it on materials developed for Discover Languages activities as well as for other printed or web site applications so as to demonstrate the organization’s support of and involvement in Discover Languages. Such organizations are urged to direct their constituents to the www.discoverlanguages.org web site in order to buy specialty products carrying the Discover Languages logo. If an organization develops an item not available from ACTFL, permission to include the logo must be obtained from ACTFL. At ACTFL’s discretion, a percentage of proceeds from the sale of these products will be paid to ACTFL to help defray costs of campaign development and promotion.
II. Commercial use
Any use of the Discover Languages name and logo by commercial entities must be approved by ACTFL. On an individual basis, ACTFL will establish a royalty arrangement for any commercial use that ACTFL approves.Use of the logo must avoid any suggestion of ACTFL’s endorsement of the product or company.
III. Logo downloads and use
The Discover Languages official logo is available for download at www.discoverlanguages.org. The logo, including the web site url and the full name of ACTFL, MUST be used in its entirety and as it appears in the logo file, and only according to the other provisions of this notice. The official colors are indicated and must be adhered to exactly if the logo is used in color. The logo may also be used in black. The elements in the logo may not be repositioned or altered in any way. ACTFL encourages organizations to add their organization name to the logo. Placing the Discover Languages logo on your website: When placing the logo on your website, we ask that you make the logo an active link to www.discoverlanguages.org.
IV. Editorial and advertising use
Any individual or organization wishing to reproduce the Discover Languages name or logo in any editorial article or advertisement must submit a request for such use to ACTFL not less than 2 weeks prior to the planned date of publication. This will give ACTFL adequate time to review each request and respond in a timely manner. Requests must include an explanation of the intended use and a sample of that use. All authorized uses of the Discover Languages name and logo shall be considered a license from ACTFL to the authorized user. Such license is revocable in the discretion of ACTFL and may not be transferred or sublicensed in any manner by any authorized user.
VI.
The Discover Languages name and logo may not be used in any manner that, in the sole opinion of ACTFL: discredits ACTFL or tarnishes its reputation and goodwill; is false or misleading; violates the rights of others; violates any law, regulation, or other public policy; or mischaracterizes the relationship between ACTFL and the user, including but not limited to any use that might be reasonably construed as an endorsement, approval, sponsorship, or certification by ACTFL of the user, the user's business or organization, or the user's products or services.
VII.
Use of the Discover Languages name and logo shall create no rights for users in or to the name or logo or their use beyond the terms and conditions of this limited and revocable license. The Discover Languages name and logo shall remain at all times the sole and exclusive intellectual property of ACTFL, and ACTFL reserves the right to prohibit use of the Discover Languages name and logo in its sole discretion.

Question: I am a high school teacher and I would like to put the Discover Languages logo on a promotional flyer to send to parents and to other schools in our district. Is this permissible?
Answer: Yes, you may use the logo in literature designed to promote Discover Languages.
Question: I am the department head of a large elementary school and we would like to produce Discover Languages t-shirts to sell as a fund-raising project. Can this be done?
Answer: Generally, Discover Languages logo products must be purchased from ACTFL. If a non-profit organization wants to produce apparel carrying the logo AND the school’s name, ACTFL may grant permission but will require a percentage of the proceeds generated in order to support the Discover Languages initiative. Please contact ACTFL for bulk discounts and ordering information on Discover Languages products or to request special logo use permission.
Question: I am a text book publisher and am planning to produce and sell a book for middle school language students. May I put the Discover Languages logo on the cover of the book?
Answer: No, only Discover Languages sponsors are allowed use of the logo. Any other company seeking to use the logo for commercial purposes must contact ACTFL to establish a royalty payment arrangement and to request permission for the use of the logo. Companies interested in becoming a Discover Languages sponsor should contact ACTFL.
